Terms and conditions

  1. Definitions: In this document, the following terms shall have the meanings assigned to them below:

Listing“: Rental or shared navigation offer published by an owner on the Veryboat platform.

User“: Any person who accesses and uses the Veryboat platform.

Charterer”: Person who books a boat for rental.

Owner”: Person or entity that makes a boat available for rental.

Boat“: Watercraft available for rental on the platform.

Dutch auction“: Auction method where the price starts high and progressively decreases until a user accepts the offer.

Coupon“: A coupon is a code or voucher that provides a benefit, such as a discount, special offer, or promotion on a boat rental. It may be in physical or digital format and usually has specific conditions, such as an expiration date or a minimum purchase amount.

Service“: Set of tools and functionalities offered by Veryboat to connect owners and charterers.

  1. Acceptance of Terms and Conditions: Access and use of Veryboat implies full acceptance of these Terms and Conditions. If the user does not accept them, they must refrain from using the platform.
  2. Nature of the Veryboat Service: Veryboat is a brokerage platform between boat owners and charterers interested in renting. It is not a party to the contracts entered into between the parties and does not guarantee their fulfillment.
  3. Registration and Account Creation: The user must register by providing valid and truthful information. Veryboat reserves the right to request verification documents. The account is personal and non-transferable.
  4. Listing Publication: The owner may publish listings detailing characteristics, prices, and rental conditions. Listings must contain clear and verifiable information. The platform reserves the right to remove listings that do not meet its quality standards.
  5. Identification Requirements: Veryboat may request additional identity verification before confirming reservations.
  6. Booking and Payment Process: The charterer will select a boat and submit a booking request. Once accepted, the payment will be made through the platform and held until the service is completed. Veryboat may charge service management fees.
  7. Exclusive Use of the Platform: All transactions must be made through the Veryboat platform. To confirm the reservation, the charterer must pay 50% of the rental amount through the platform. The remaining 50% must be paid directly to the broker or the boat owner.
  8. Additional Fees and Services: Owners may include extra fees for additional services, provided they are clearly specified in the boat’s listing.

Additional services not detailed in the listing, such as drinks, food, restaurant reservations, or other add-ons, must be agreed directly between the charterer and the captain or owner. Veryboat is not responsible for these agreements or their fulfillment.

  1. Fraud Protection: Veryboat implements security measures to detect fraudulent activities on the platform.
  2. Protection of Banking Information: Payment data will be protected and encrypted.
  3. Payment Terms for Owners: Payments to owners will be processed within the timeframe established by Veryboat, subject to possible security checks.
  4. Price Modification: The owner may modify the boat’s price until the reservation is confirmed. However, they may not change the base price just before a Dutch auction is activated.
  5. Dutch Auction: Veryboat allows reverse auctions in which the boat price starts high and decreases until a user accepts the offer. The owner may set a minimum acceptable price.

The Charterer accepts the conditions and, to formalize the reservation, must pay 50% of the rental amount. The remaining amount, as well as the deposit if applicable, must be paid directly to the owner or broker on the check-in day.

  1. Security Deposit: The owner may require a security deposit, which will be specified in the listing. Veryboat may retain the deposit in case of damages or non-compliance. The refund will be processed after the boat’s condition is verified.
  2. Late Return Penalties: If the charterer returns the boat after the agreed time, additional charges may apply.
  3. Coupons:

Rental discount: A fixed amount or percentage off the total rental price.

Commission reduction: Lower service fees for the user or owner.

Free extras: Additional services at no cost, such as fuel, water sports equipment, or extra rental time.

Special conditions: Access to an exclusive offer, such as priority in Dutch auctions or flexible cancellation.

Coupons on Veryboat may be applied during the booking process and are subject to specific conditions such as certain dates, boat types, or availability.

Coupons are nominative, cannot be used in auctions, and cannot be combined within the same transaction.

User Loyalty Program:

A.Point Accumulation

Veryboat users can accumulate loyalty points through various activities on the platform:

Completed bookings:

For each euro spent in an auction, the user earns 1 point.

Example: If a user wins an auction for €500, they will receive 500 points.

Additional actions:

10 points for registering and completing their profile.

100 points for leaving a Google review about their Veryboat experience.

100 points for referring to a friend who completes their first booking.

B.Loyalty Benefits and Levels

Accumulated points will grant access to different loyalty levels with exclusive benefits:

Basic Level (0 – 5,000 points)

Access to priority auction alerts.

5% discount on the next booking (not applicable to auctions).

Advanced Level (5,001 – 10,000 points)

5% discount on all bookings made within the same year (not applicable to auctions).

Free experiences such as a bottle of champagne on board.

Early access to high-demand boats.

Premium Level (10,001+ points)

Free experience: right to a 9-meter boat valued up to €2,500.

Priority access to auctions.

C.Point Redemption

Accumulated points can be redeemed within the current year for various benefits with the following equivalences:

100 points = €10 discount.

Conditions:

Points are non-transferable and cannot be exchanged for cash.

Veryboat reserves the right to modify the loyalty program conditions at any time.

  1. Charterer’s Responsibility:

Prohibition of Navigation Without Documentation: The charterer must carry all required documentation for navigation and present it to authorities when necessary.

Responsibility for Fines and Penalties: Any fines or penalties imposed by maritime authorities during the rental period shall be the sole responsibility of the charterer.

Inspection, Damages, and Incident Reporting: The charterer agrees to immediately report any incident, accident, or damage occurring during the use of the boat.

Liability for Damage to Third Parties: The charterer shall be liable for any damage caused to other boats, structures, or maritime facilities during the rental.

Environmental Protection: It is strictly forbidden to damage coral reefs, capture protected species, or harm the marine ecosystem. The charterer must comply with all current environmental regulations.

Consequences of Non-Compliance: Failure to comply with these rules may result in legal penalties, additional fines, and immediate termination of the rental contract without refund.

Obligation to Report Accidents: The charterer must immediately inform the owner and the authorities in the event of a serious accident or incident.

Boat Condition Obligations: The charterer agrees to respect the rental conditions and return the boat in the same condition in which it was delivered, ensuring no structural damage is caused.

Prohibition of Boat Modifications: The charterer may not make any modifications to the boat without prior authorization.

Boat Usage Rules: The charterer must respect the established navigation rules and ensure compliance with local regulations.

Prohibition of Subleasing: The charterer may not sublease the boat without the express authorization of the owner.

Mooring Conditions: The charterer must follow the rules of the ports and marinas where the boat docks.

Liability Insurance: The charterer must have civil liability insurance if required by local regulations.

Overload Control: The charterer must respect the maximum number of people allowed on board.

Supervision of Minors: The charterer is responsible for the supervision and safety of minors on board.

Emergency Procedures: The charterer must follow emergency procedures as indicated by the owner and maritime authorities.

Anchoring Conditions: The charterer must follow the owner’s instructions on where and how to anchor the boat.

Obligation to Obey Maritime Signals: The charterer must respect all maritime signals and comply with port regulations.

Responsibility in Medical Emergencies: The charterer must inform the crew of any pre-existing medical conditions that may affect safety on board.

Penalty for Boat Abandonment: The charterer will be penalized if they abandon the boat without notice or without ensuring its proper safeguarding.

Use of Onboard Equipment: The charterer is responsible for the proper use of navigation and entertainment equipment.

  1. Owner’s Responsibility:

a) Maintenance: The owner is responsible for the regular maintenance of the boat and ensuring its optimal condition.

b) Owner’s Obligations: The owner must ensure the boat complies with current regulations and provides all required documentation. They must also ensure the boat is in optimal condition for navigation.

c) Inspection, Damages, and Incident Reporting: Before and after the rental, the owner and the charterer must jointly inspect the boat to verify its condition. Any damage occurring during the rental period will be the responsibility of the charterer.

d) Insurance: The owner is responsible for having appropriate insurance coverage for renting their boat. The charterer may purchase additional insurance through the platform. Veryboat assumes no responsibility for incidents occurring during the rental.

  1. Captain’s Responsibility:

a) If the rental includes a captain, they must comply with safety regulations and operate the boat professionally.

b) The assigned captain must remain sober at all times to ensure the safety of the boat and its occupants.

  1. Cancellation and Refund Policy:

Refund Policy: Refunds are subject to the cancellation policy set by each owner, which must be clearly and visibly indicated in each boat listing.

Each owner may define their own cancellation terms, provided they are written in a clear and accessible manner for the charterer.

In case the cancellation is initiated by the charterer, the terms specified in the corresponding listing will apply. Veryboat also reserves the right to withhold part of the amount paid as a penalty.

Cancellations Due to Force Majeure: In case of cancellations caused by extreme weather conditions or other force majeure events beyond the parties’ control, a full or partial refund may be granted depending on the specific circumstances and the owner’s policy.

Owner’s Responsibility in Case of Breakdown: The owner must ensure the boat is in optimal operating condition. In case of a breakdown not attributable to the charterer, a replacement boat may be offered or, alternatively, a partial refund.

Cancellation Due to Health Reasons: If a charterer is unable to travel due to medical reasons, proof must be presented to request cancellation or a partial refund.

Cancellation by Veryboat: Veryboat reserves the right to cancel any reservation if fraud or suspicious activity is detected.

Penalties for No-Show by Charterer: If the charterer does not show up at the agreed time and date without prior notice, the owner may retain the reservation amount.

  1. Navigation Regulations and Restricted Areas:

Protected Areas and Marine Reserves: It is strictly prohibited to navigate in protected areas or marine reserves without the required permits and without complying with environmental regulations. Users must inform themselves in advance and comply with the specific provisions of each zone aimed at preserving biodiversity.

Local and International Regulations: The charterer must comply with the applicable navigation laws and regulations in the rental area. In case of navigation beyond national waters, international regulations and any additional requirements must be followed.

Islands and Private Properties: Disembarking on private islands or properties without proper authorization is strictly prohibited.

Maritime Construction and Protected Wildlife Areas: Navigation is not allowed in areas where maritime infrastructure work is underway or in reproduction zones or habitats of protected species, to prevent ecosystem disruption and ensure occupant safety.

Navigation in Deep Waters: Navigating in deep waters is only permitted when wearing life jackets and with active and appropriate safety equipment.

Conditions for Open Sea Stops: Open sea stops must only be made under safe conditions and following the owner’s instructions.

Environmental Responsibility: Users must respect the environment and avoid polluting water bodies.

Prohibition of Use in High-Risk Areas: Navigation in conflict zones, high maritime traffic areas, or natural hazard zones is prohibited without express authorization.

Restrictions in Marine Conservation Areas: Dumping waste or engaging in activities that could harm protected ecosystems is prohibited.

Mooring Restrictions in Unauthorized Areas: The charterer may not moor the boat in private or restricted areas without authorization.

  1. Rules on Alcohol and Drug Consumption:

1.Prohibition of Drug Use: Drug consumption on board during navigation is strictly prohibited.

2.Responsible Alcohol Consumption: Alcohol consumption is allowed but must be done responsibly.

3.Captain’s Sobriety: The designated captain must remain sober at all times to ensure the safety of the vessel and its occupants.

4.Consequences of Non-Compliance: Any violation of these rules may result in the immediate termination of the rental without refund, as well as potential penalties under applicable law.

  1. Prohibition of Unauthorized Fishing Activities: Any fishing activity must comply with local regulations.
  2. Restrictions on Use and Operation of Drones: The use of the vessel is strictly limited to legal, safe, and authorized purposes. It is prohibited to use it for illegal, dangerous, or risky activities. Additionally, the use of drones on board must comply with current local regulations, including those related to safety, privacy, and airspace.
  3. Pet Policy: The owner may establish restrictions regarding the presence of pets on board.
  4. Use of Safety Equipment: All occupants must use safety equipment, such as life jackets, in situations required by law.
  5. Fuel Use and Return: The charterer must return the vessel with the same fuel level as received. Otherwise, the cost of refueling to reach that level will be charged at the end of the rental period. If fuel consumption exceeds the limit agreed in the contract, an additional charge may apply as a penalty for excessive use.
  6. Restrictions on Alternative Fuel Use: If the vessel uses biofuels or other energy sources, the charterer must follow the owner’s instructions.
  7. Regulation on the Use of Portable Generators: The use of portable generators must comply with safety regulations and not generate excessive noise.
  8. Conditions for Use of Alternative Propulsion: If the vessel has an electric or hybrid motor, the charterer must follow the owner’s instructions for charging and usage.
  9. Restrictions on Sports Activities: Water sports activities must comply with local regulations and have the necessary permits.
  10. Night Navigation Rules: Night navigation is only allowed if the vessel has appropriate equipment and local regulations are followed. Additionally, each boat listing must explicitly state whether this option is permitted.
  11. Prohibition of Excessive Noise and Loud Music: Excessive noise is strictly prohibited, including loud music played through speakers, especially in shared navigation zones, protected areas, or when it may disturb other vessels or coastal residents. The use of fireworks or other pyrotechnic devices is also prohibited without permission from the authorities and the owner.
  12. Restrictions on Use of Vessels for Mass Events: Rented vessels may not be used as platforms for events without prior authorization.
  13. Responsible Use of Wastewater Systems: It is prohibited to discharge waste or black water into the sea without using proper systems.
  14. Usage Restrictions During Specific Seasons: Some vessels may have usage restrictions during certain seasons due to weather conditions or local regulations.
  15. Prohibition of Transporting Hazardous Materials: It is strictly prohibited to transport explosives, flammable, or hazardous substances on the vessel.
  16. Prohibition on Use for Competitions or Races: Rented vessels may not be used for races, competitions, or any competitive event without express authorization.
  17. Use of Radio and Communication Systems: The charterer must be familiar with the emergency communication systems on board and use them only when justified.
  18. Regulation on Radar and Navigation Systems: If the vessel has radar or advanced navigation systems, they must be authorized by the owner and operated by qualified individuals.
  19. Regulations on Nautical Parking: The charterer must follow dock regulations and pay applicable fees when necessary.
  20. Speed Use Conditions: It is not permitted to exceed speed limits in restricted or protected navigation areas.
  21. Regulation on Use of Outboard Motors: Outboard motors must only be handled by experienced or certified individuals.
  22. Regulation on Two-Stroke Engines: The use of two-stroke engines may be restricted in certain areas due to environmental regulations.
  23. Energy Use Regulations Onboard: The charterer must manage battery and generator use appropriately to avoid failures during the trip.
  24. Regulation on Use of Renewable Energy Onboard: If the vessel has solar panels or other renewable systems, their use must be managed efficiently.
  25. Food and Waste Storage Regulation: Suitable containers must be used to prevent contamination of the vessel and the marine environment.
  26. Restrictions on Transporting Exotic Animals: Transporting exotic animals is not allowed without the required documentation and permits.
  27. Obligation to Comply with Boarding and Disembarking Procedures: The charterer must follow safety rules when boarding and disembarking the vessel.
  28. Regulation on the Use of Safety Buoys: Safety buoys must be used at all times in anchoring and mooring areas.
  29. Regulation on Emergency Devices: The charterer must know the location and use of flares, lifebuoys, and other safety equipment.
  30. Regulations on the Use of Fresh Water Onboard: Fresh water consumption must be rationalized to avoid depletion during long trips.
  31. Prohibition of Smoking in Restricted Areas: Smoking is prohibited in fuel storage areas and enclosed spaces without proper ventilation.
  32. Single-Use Plastics: Use of single-use plastics is discouraged; eco-friendly alternatives are recommended.
  33. Diving & Snorkeling Equipment: The charterer must hold valid certification to use scuba diving equipment.
  34. Participation in Regattas: Charterers must obtain prior authorization from the owner and the event organizer.
  35. Use of Portable Generators: Must comply with safety regulations and not produce excessive noise.
  36. Prohibition on Weapons: Transporting or using weapons or dangerous objects onboard is prohibited.
  37. Use of Electronic Equipment: Devices like GPS, radios, and communications must follow local maritime laws.
  38. Unauthorized Refueling: Only allowed at authorized stations, respecting all safety norms.
  39. Mooring Equipment: Proper mooring must be used, and the owner’s guidance followed to avoid damage.
  40. Weather Conditions: Trips must be postponed or owner’s instructions followed in unsafe weather.
  41. Luggage Transport: Respect weight/volume limits and avoid hazardous items.
  42. Auxiliary Vessels: Auxiliary boats may only be used in situations authorized by the owner and within safe areas.
  43. Restrictions on the Use of Parasailing and Extreme Sports: The use of parasailing and other extreme sports activities is prohibited without the authorization of the owner and the relevant authorities.
  44. Regulations on the Use of Life Jackets: All passengers must wear life jackets in risky situations or when instructed by the owner.
  45. Rules on the Transport of Fishing Equipment: The lessee may only transport fishing equipment if they have the necessary permits and comply with conservation regulations.
  46. Polluting Chemicals: Discharge of harmful substances into the sea is strictly prohibited.
  47. Restriction on Unsupervised Diving Activities: Diving activities may only be carried out under the supervision of a certified instructor and in permitted areas.
  48. Regulation on the Use of Underwater Cameras: The use of underwater cameras must comply with marine conservation regulations and must not disturb wildlife.
  49. Regulations on the Use of Ropes and Anchors: Anchors must be placed in designated areas and must not damage the seabed.
  1. Regulations on the Use of Security Alarms: If the vessel is equipped with security alarms, they must remain activated when the vessel is anchored or unattended.
  2. Regulations on the Use of Hot Water and Showers Onboard: The use of hot water and showers must be done in a rational manner to avoid waste.
  3. Prohibition on Using the Vessel as a Permanent Residence: The vessel may not be used as a permanent residence without the owner’s authorization.
  4. Liability in Case of Loss or Damage to Equipment: The lessee shall be solely responsible for the loss or damage of any equipment or accessory provided with the vessel. Veryboat and the lessor shall not assume any liability in such cases.
  5. Regulations on the Use of Internet Onboard: If the vessel is equipped with an internet connection, the lessee must use it responsibly.
  6. Regulations on the Use of Unauthorized Fishing Equipment: The lessee must refrain from using nets or fishing methods that are prohibited by local legislation.
  7. Regulations on the Use of Cooking Equipment: The lessee must use the cooking equipment responsibly and clean it after use.
  8. Restrictions on the Transport of Commercial Goods: The transport of goods for commercial purposes is not allowed without authorization.
  9. Prohibition of Unauthorized Advertising or Promotion: The use of the vessel for advertising purposes is not permitted without the authorization of the owner and Veryboat.
  10. Ownership Rights of Audiovisual Material: The owner and the lessee must agree on the use of any images or videos captured during the experience.
  11. Prohibition of Commercial Use: The lessee may not use the vessel for commercial purposes without authorization.
  12. Penalties for Breach and Unauthorized Use: Failure to comply with the terms and conditions of the contract, as well as any unauthorized use of the vessel or use beyond the agreed scope, may result in penalties, including financial sanctions, immediate termination of the rental, and/or expulsion of the user from the Veryboat platform.
  13. Liability Limits: Veryboat shall not be held responsible for losses resulting from technical issues on the platform.
  14. Use of Intellectual Property: Users may not use third-party images or texts without authorization.
  15. Applicable Law, Jurisdiction, and Legal Actions: This contract shall be governed by the laws in force in the jurisdiction where Veryboat operates.
    In the event of a dispute, both parties expressly submit to the competent courts of that jurisdiction, waiving any other jurisdiction that may apply to them.
    Veryboat reserves the right to take any legal action it deems necessary against any user who breaches the established terms and conditions..
